§ 196A-12. Coastal Erosion

D. Coastal banks significant to storm damage prevention or flood control as vertical buffers to storm waters

Where a coastal bank is determined to be significant to storm damage prevention or flood control solely because it is a vertical buffer to stormwaters, and such bank is not found to be significant to storm damage prevention or flood control because it supplies sediment to coastal beaches, dunes, or barrier beaches, the Orleans Conservation Commission may, but is not required to do so, permit construction of bulkheads, revetments, seawalls, gabions, groins, or other Coastal Engineering Structure that is designed to alter wave, tidal, or sediment transport processes in order to protect inland or upland structures from the effects of such processes provided that such structures qualify for protection under 196A-12.H or 196A-12.I.
